Agency relationships and how we get paid

OC Office Space is operated by Topside Real Estate, a California licensed real estate broker, license #01373045, located at 2091 San Joaquin Hills Rd, Newport Beach, CA 92660. Rob Rader is the responsible broker.

Who we represent

When you submit a space requirement, Topside may act as your agent in locating and negotiating for commercial space. When an owner lists property through this site, Topside acts as the owner’s agent under a written listing agreement.

Dual agency

Because Topside represents both occupiers and owners, there will be transactions in which Topside is the agent for both parties. California Civil Code §2079.13 et seq. requires that a dual agency be disclosed to, and consented to in writing by, both parties. Topside discloses any dual-agency situation in writing before a tour of the affected property, and again in the transaction documents. A dual agent may not, without the express permission of the respective party, disclose to the other party that the owner will accept less than the listing price or that the occupier will pay more than the offered price or rent.

Compensation

Occupiers who submit requirements through this site pay no fee to Topside for representation. Topside’s compensation on a lease or sale is paid by the property owner under the terms of the owner’s listing agreement or a cooperating-broker agreement. Fee amounts are stated in writing in those agreements before any property is marketed.

No guarantee

Submitting a requirement or inquiry does not create an agency relationship or any obligation on either party until a written agreement is signed. Listing information is believed accurate but is not guaranteed and is subject to change, prior lease or sale, and withdrawal without notice.
